1. About these terms

These Terms of Use (“Terms”) govern your use of the Lúnula app for iPhone (“Lúnula”, “the app”) and the website lunula.lifestyle, published by Rubén García (“we”, “us”). By downloading or using Lúnula you accept these Terms.

Lúnula is licensed to you under Apple’s Licensed Application End User License Agreement (Standard EULA). These Terms complement it with information specific to Lúnula. Nothing in these Terms limits the rights you have as a consumer under the laws of your country.

2. Lúnula is not medical advice

• Lúnula is an informational and wellbeing app. Its predictions (periods, phases, fertile window, ovulation, moods) are estimates based on the data you enter and on population studies, and they can be wrong.
• Lúnula is not a medical device, does not diagnose, treat or prevent any condition, and does not replace the advice of a doctor, gynecologist or other health professional.
• Lúnula is not a method of contraception and must not be used to avoid or achieve pregnancy.
• Health alerts in the app (for example, about intense pain or heavy bleeding) are a gentle invitation to consult a professional, never a diagnosis. In an emergency, call your local emergency number.

3. Consent and respect

Lúnula exists to help people understand their own bodies and to support the people they love. You agree to use it in that spirit:

• Only follow another person’s cycle if she knows it and agrees. Lúnula encourages you to ask her openly, and the best way is for her to share her cycle with you from her own app.
• Do not use Lúnula to monitor, control, pressure or harass anyone, or in any way that infringes their privacy or the law.
• The information you enter about another person is your responsibility. If she asks you to stop following her cycle, delete her profile.

4. Your license

We grant you a personal, non-exclusive, non-transferable license to use Lúnula on Apple devices that you own or control, as permitted by the App Store rules. You may not copy, modify, distribute, sell or rent the app, reverse-engineer it (except where the law allows it) or use it for any unlawful purpose.

5. Lúnula Plus

• One-time purchase. Lúnula Plus is a non-consumable in-app purchase. You pay once and it does not renew; there is no subscription.
• Price. $4.99 in the United States (plus any applicable taxes). In other countries Apple sets the equivalent price in local currency; the price shown in the App Store before you confirm is the one that applies.
• What it includes. Reminders with tips at every phase, a heads-up before the period and a daily reminder; PDF report; receiving your partner’s cycle; full history and trends; extended content and guides; sky themes. Features available for free when you purchased will remain free.
• Payment. Apple processes the payment with your Apple Account under the App Store’s terms. We never receive your payment details.
• Restore. You can restore your purchase on your other devices with the same Apple Account (“Restore purchase”).
• Refunds. Refunds are handled by Apple according to its policies. You can request one at reportaproblem.apple.com. If a purchase is refunded, Lúnula Plus will be deactivated on your devices and basic features will remain.
• Right of withdrawal (EU). Lúnula Plus is digital content supplied immediately after purchase. By confirming the purchase you request immediate access, and you may lose your right of withdrawal once the content has been supplied, as allowed by EU consumer law. This does not affect Apple’s refund process.

6. Your data and backups

Lúnula stores your information only on your device (see the Privacy Policy). Because we do not keep any copy, we cannot recover your data if you lose your phone, delete the app or erase your data. To protect it, export a backup from the app regularly and keep it in a safe place, or keep your iPhone backups enabled.

7. Availability and updates

We work to keep Lúnula useful and working well, and we may release updates that improve, change or remove features. Some updates may be necessary to keep using the app. We do not guarantee that the app will be available in every country or will be compatible with every device or iOS version.

8. Intellectual property

Lúnula, its name, logo, design, texts, illustrations and code belong to Rubén García or are used under license, and are protected by intellectual property laws. The scientific sources cited in the app belong to their respective authors. Apple, iPhone and App Store are trademarks of Apple Inc.

9. Warranty and liability

Lúnula is offered with care, but “as is” and “as available”. To the extent permitted by law, we do not guarantee that predictions will be accurate or that the app will be error-free or uninterrupted.

To the extent permitted by law, we are not liable for indirect or consequential damages, loss of data or decisions taken based on the app’s estimates. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for intent or gross negligence, or your statutory rights as a consumer.

10. Apple

These Terms are between you and us, not Apple. Apple is not responsible for Lúnula or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to it (such as product liability, legal compliance or intellectual property). If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

11. Applicable law

These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring claims before the courts of your place of residence. The European Commission’s online dispute resolution information is available at consumer-redress.ec.europa.eu.

12. Changes and contact

We may update these Terms to reflect changes in the app or the law. We will publish the new version on this page with its effective date and, if the change is significant, we will let you know in the app. For any question, write to [email protected].

Estas condiciones de uso («Condiciones») regulan el uso de la app Lúnula para iPhone («Lúnula», «la app») y de la web lunula.lifestyle, publicadas por Rubén García («nosotros»). Al descargar o usar Lúnula aceptas estas Condiciones.

Lúnula se te concede bajo la licencia estándar de usuario final de Apple (EULA estándar). Estas Condiciones la complementan con información propia de Lúnula. Nada de lo que dicen limita los derechos que tienes como consumidor según las leyes de tu país.

2. Lúnula no es consejo médico

• Lúnula es una app informativa y de bienestar. Sus predicciones (reglas, fases, ventana fértil, ovulación, ánimo) son estimaciones basadas en los datos que introduces y en estudios poblacionales, y pueden equivocarse.
• Lúnula no es un producto sanitario, no diagnostica, trata ni previene ninguna enfermedad, y no sustituye el consejo de un médico, ginecólogo u otro profesional sanitario.
• Lúnula no es un método anticonceptivo y no debe usarse para evitar ni para buscar un embarazo.
• Los avisos de salud de la app (por ejemplo, sobre dolor intenso o sangrado abundante) son una invitación delicada a consultar con un profesional, nunca un diagnóstico. En caso de urgencia, llama al 112 o al número de emergencias de tu país.

3. Consentimiento y respeto

Lúnula existe para ayudar a entender el propio cuerpo y a acompañar a quien se quiere. Te comprometes a usarla con ese espíritu:

• Sigue el ciclo de otra persona solo si ella lo sabe y está de acuerdo. Lúnula te anima a preguntárselo abiertamente, y la mejor forma es que ella te comparta su ciclo desde su propia app.
• No uses Lúnula para vigilar, controlar, presionar ni acosar a nadie, ni de ninguna forma que vulnere su intimidad o la ley.
• La información que introduces sobre otra persona es responsabilidad tuya. Si te pide que dejes de seguir su ciclo, borra su perfil.

4. Tu licencia

Te concedemos una licencia personal, no exclusiva e intransferible para usar Lúnula en dispositivos Apple que te pertenezcan o controles, según las normas del App Store. No puedes copiar, modificar, distribuir, vender ni alquilar la app, aplicarle ingeniería inversa (salvo en lo que permita la ley) ni usarla con fines ilícitos.

5. Lúnula Plus

• Pago único. Lúnula Plus es una compra no consumible dentro de la app. Pagas una vez y no se renueva; no es una suscripción.
• Precio. 4,99 € en España (IVA incluido). En otros países Apple fija el precio equivalente en la moneda local; se aplica el precio que muestra el App Store antes de confirmar la compra.
• Qué incluye. Avisos con consejo en cada fase, aviso antes de la regla y recordatorio diario; informe PDF; recibir el ciclo de tu pareja; historial completo y tendencias; contenido ampliado y guías; temas del cielo. Las funciones que eran gratuitas cuando compraste seguirán siéndolo.
• Pago. Apple procesa el pago con tu cuenta de Apple según las condiciones del App Store. Nosotros nunca recibimos tus datos de pago.
• Restaurar. Puedes restaurar la compra en tus otros dispositivos con la misma cuenta de Apple («Restaurar compra»).
• Reembolsos. Los gestiona Apple según sus políticas. Puedes solicitarlo en reportaproblem.apple.com. Si se reembolsa una compra, Lúnula Plus se desactivará en tus dispositivos y seguirán las funciones básicas.
• Derecho de desistimiento (UE). Lúnula Plus es contenido digital que se suministra inmediatamente tras la compra. Al confirmar la compra solicitas el acceso inmediato y puedes perder el derecho de desistimiento una vez suministrado el contenido, como permite la normativa europea de consumo. Esto no afecta al proceso de reembolso de Apple.

6. Tus datos y copias de seguridad

Lúnula guarda tu información solo en tu dispositivo (consulta la política de privacidad). Como no conservamos ninguna copia, no podemos recuperar tus datos si pierdes el teléfono, borras la app o eliminas tus datos. Para protegerlos, exporta de vez en cuando una copia desde la app y guárdala en un lugar seguro, o mantén activadas las copias de seguridad de tu iPhone.

7. Disponibilidad y actualizaciones

Trabajamos para que Lúnula sea útil y funcione bien, y podemos publicar actualizaciones que mejoren, cambien o eliminen funciones. Algunas pueden ser necesarias para seguir usando la app. No garantizamos que la app esté disponible en todos los países ni que sea compatible con todos los dispositivos o versiones de iOS.

8. Propiedad intelectual

Lúnula, su nombre, logotipo, diseño, textos, ilustraciones y código pertenecen a Rubén García o se usan con licencia, y están protegidos por las leyes de propiedad intelectual. Las fuentes científicas citadas en la app pertenecen a sus autores. Apple, iPhone y App Store son marcas de Apple Inc.

9. Garantía y responsabilidad

Lúnula se ofrece con cariño, pero «tal cual» y «según disponibilidad». En la medida en que lo permita la ley, no garantizamos que las predicciones sean exactas ni que la app esté libre de errores o interrupciones.

En la medida en que lo permita la ley, no respondemos de daños indirectos, pérdida de datos ni decisiones tomadas a partir de las estimaciones de la app. Nada de estas Condiciones excluye ni limita la responsabilidad que la ley no permite excluir o limitar, como la derivada de dolo o culpa grave, ni tus derechos legales como consumidor.

10. Apple

Estas Condiciones son un acuerdo entre tú y nosotros, no con Apple. Apple no es responsable de Lúnula ni de su contenido, no tiene obligación de ofrecer mantenimiento ni soporte, y no es responsable de atender reclamaciones relacionadas con la app (como responsabilidad por producto, cumplimiento normativo o propiedad intelectual). Si la app no cumple alguna garantía aplicable, puedes notificarlo a Apple y Apple te reembolsará el precio de compra, si lo hubo; en la máxima medida permitida por la ley, Apple no tiene ninguna otra obligación de garantía. Apple y sus filiales son terceros beneficiarios de estas Condiciones y pueden exigir su cumplimiento. Confirmas que no te encuentras en un país sujeto a embargo del Gobierno de EE. UU. ni figuras en ninguna lista de personas prohibidas o restringidas del Gobierno de EE. UU.

11. Ley aplicable

Estas Condiciones se rigen por la ley española. Si eres consumidor, conservas además la protección de las normas imperativas del país donde vives y puedes reclamar ante los tribunales de tu domicilio. La información de la Comisión Europea sobre resolución de litigios está disponible en consumer-redress.ec.europa.eu.

12. Cambios y contacto

Podemos actualizar estas Condiciones para reflejar cambios en la app o en la ley. Publicaremos la nueva versión en esta página con su fecha de entrada en vigor y, si el cambio es importante, te lo indicaremos en la app. Para cualquier duda, escribe a [email protected].
